Criminal and Civil Law & the Supreme Court

The purpose of this proyect is to: Test the learner’s knowledge of the systems of criminal and civil law in Ireland. Learners will be expected to demonstrate knowledge of the substantive differences between both types of law as well as the clear procedural differences in the ways criminal and civil cases are dealt with by the Irish Courts. Test the learner’s knowledge of the role of the Irish Supreme Court in defining the law in Ireland. Learners will be expected to demonstrate a clear knowledge of the structure and importance of the Supreme Court of Ireland as well as its origins under the Irish Constitution. Learners will be expected to provide a detailed discussion of the evolution of the Supreme Court’s role in defining Irish law and, in particular, its role in expanding the rights afforded to citizens under the Irish Constitution (unenumerated rights). Learners will be expected to provide at least five examples of specific cases in which the Supreme Court has helped to shape Irish law. You are required to: 1. Discuss the differences between the criminal and civil law in Ireland (25%). 2. “The Irish Supreme Court is the highest judicial authority in Ireland and has been responsible, through its many ground-breaking judgments, for shaping the legal rights and obligations of each and every citizen of the State” Critically assess the above statement, making specific reference to the origins, powers and structure of the Irish Supreme Court and the role it plays in shaping the law in Ireland. In your answer you must provide examples of at least five Supreme Court cases which you believe helped to shape the legal rights and obligations of citizens of the State. Specific Requirements 1. Your project should be in a Word document, Font Size 12 (including headings and subheadings), and the font type should be Times New Roman or Ariel, line spacing should be 1.5; 2. As this is an academic project you should include examples of referencing and in text citation.
